Not Guilty Verdict in Reading PA Robbery and Aggravated Assault Case

Attorney Dan Nevins won a full jury acquittal this week in the Berks County Court of Common Pleas. Our client had been charged with 25 counts including multiple counts of Felony 1 Robbery and Aggravated Assault involving a shooting that occurred in West Reading, PA. The allegations were that our client and a Co-Defendant made an attempt to rob a drug buyer at gunpoint. Subsequent to the attempted robbery our client was alleged to have Hindered the Apprehension of another, which itself was a separate felony case.
At the end of the Commonwealth’s testimony Attorney Nevins won a Judgment of Acquittal on 13 of the charges and the remaining 12 went forward to the Jury. During closing argument Attorney Nevins successfully argued that the Commonwealth’s complaining witness lacked any credibility due to his own inconsistent statements and criminal charges. The jury came back with a not guilty verdict on all remaining counts within 40 minutes of being sworn in. Our client had been facing over a 100 year maximum possible penalty if convicted.

Not Guilty Verdict in Reading, PA Burglary Trial

Attorney Dan Nevins won a jury verdict last week for a client charged with Felony Burglary in Berks County, PA. The Client had been accused of breaking into the home of an acquaintence and stealing over $40,000 in rare coins, collectibles and cash. The case was particularly difficult since police found some of the alleged stolen items at Client’s residence and police claimed that Client had made an incriminating statement.

In the end, the Jury acquitted the Client of all felony counts including Burglary, Criminal Trespass and Theft. The Jury found him guilty only of Receiving Stolen Property at the misdemeanor level – and consequently saving Client from being ordered to pay over $40,000 in restitution.

Burglary Charges Withdrawn in Berks County Case

The client had been accused of entering a rural Berks home and stealing various coins and other collectibles worth several thousands of dollars. Misdemeanor Assault and Threats Charges Dismissed

Attorney Ryan W. McAllister recently represented a client in Berks County who was charged with numerous misdemeanor offenses, including simple assault and terroristic threats. Our client had gotten into a heated argument with his wife and adult son over some personal family issues. The police were called, and, after an investigation, our client was criminally charged. At the court hearing, Attorney McAllister was able to successfully cross-examine the commonwealth witnesses to show that no physical violence took place that evening. Additionally, Attorney McAllister took the unusual step of having his client testify before the Magisterial District Judge. Attorney McAllister was able to question his client and bring out the important facts of the case.

The Judge agreed with Attorney McAllister’s argument that this was simply a family argument that involved no criminal intent. Likewise, the was no physical violence that took place. Therefore, the Judge dismissed all of the misdemeanor charges against our client. Our client was able to walk out of the courtroom without having to worry about a jail sentence or probation supervision. He was very happy with the outcome of his case.

Aggravated Assault Case Dismissed at Preliminary Hearing

The client had been charged with the Felony 1 count along with a count of misdemeanor simple assault and summary harassment for an alleged incident occurring in the city of Reading, PA earlier this month. Not Guilty Verdict in Double Homicide Trial

Last week Attorney Dan Nevins won a complete acquittal for a client charged with a double murder in Reading, PA. The client had been charged with 2 counts each of 1st and 3rd Degree Homicide as well as Conspiracy. Additionally, he was charged with Attempted Homicide in connection with a 3rd alleged shooting victim as well as multiple counts of aggravated assault.

At the conclusion of the Commonwealth’s case the Judge granted Attorney Nevins’ motion for a judgment of acquittal to all Homicide and Conspiracy Counts. Following closing arguments the Judge charged the Jury with the remaining counts including the Attempted Homicide and weapons charge. The Jury returned a full not guilty verdict four hours later east Inflatables.

The Commonwealth had alleged that the Client conspired with two others to ambush members of feuding family on Pear Street in the city of Reading.  There were two victims who were fatally wounded by gunfire and a third that had been hit with shotgun fragments.  The Commonwealth’s position was that the Client fired a shotgun from the second floor window while the other gunmen shot from a car and the street.  The Commonwealth also offered an incriminating statement allegedly made by the Client.  In the end, the Jury rejected the Commonwealth’s theories and acquitted the Client of all charges.moonwalk inflatables

Successful Superior Court Appeal in Berks County Rape Case

Attorney Julie Marburger won an important appellate victory for a client in a Sexual Assault case that went up to the Pennsylvania Superior Court. The matter was remanded back down to the Berks County Court of Common Pleas so that the client could stand trial. The client, previously represented by another Attorney, had entered a guilty plea and was sentenced by the Judge to a period of 15 years to 65 years. He was seeking a withdrawal of the plea prior to sentencing.

Simple Assault case dismissed in Reading Central Court

Today I represented a woman charged with Simple Assault for an alleged incident in Reading, Pennsylvania. In Pennsylvania Simple Assault is a misdemeanor of the 2nd degree which carries with it a maximum possible penalty of 2 years in prison and a $5,000 fine. My client had been charged with Section 2701(a)(1) alleging that she attempted to cause or did intentionally, knowingly or recklessly cause bodily injury to the victim.

The case was at the preliminary hearing stage. At this level the Commonwealth is required to establish a “prima facie” case against the defendant. If so, the charges are bound over to the court of common pleas.
In this particular case the District Judge determined that the Commonwealth could not meet their burden of proof and agreed to my request to dismiss the case.

Not Guilty Verdict in Berks County Harassment Case
