ENM Law News: “Not guilty” verdict in bench trial

Attorney Dan Nevins recently secured a “not guilty” verdict for a client charged with intimidating a witness. This client was offered a jail sentence of 9-23 months in exchange for a guilty plea. After consultation with Attorney Nevins, this client decided to proceed with a trial. The alleged victim, who was a witness against our client in a traffic case, testified at the bench trial that the client had threatened to physically assault him if he testified in the traffic case. Under direct examination by Attorney Nevins, our client testified that he and the alleged victim traded racial slurs, but no threats of violence. After hearing all of the evidence, the judge determined that the competing testimony left him with reasonable doubt and therefore he found the client “not guilty.” Thanks to the hard work of Attorney Nevins, this client avoided a conviction and lengthy jail sentence.

PFA Dismissed Following Hearing in Reading, PA

Attorney Dan Nevins won the dismissal of a Protection from Abuse Order yesterday for a client in the Berks County Court of Common Pleas. The client had been accused of engaging in a fight with his brother, with whom he resided in northern Berks County. The brother was seeking the eviction of the client from the residence and seemed to be using the PFA system to effectuate his goals.

Attorney Nevins showed the Court through cross examination that the Plaintiff was not in fear of the client and, indeed, continued to reside with him for one month following the alleged incident. In the end the Judge ruled that there was not sufficient grounds for the issuance of a PFA.

Simple Assault Charge Dismissed in Reading, PA District Court

Attorney Dan Nevins represented a client charged with a misdemeanor simple assault charge stemming from an altercation outside of a Reading, Pennsylvania bar in January 2013. The defendant was a female who was alleged to have scratched the face of a male companion during a dispute. The alleged victim and another male reported the incident to police later and charges were filed.

The preliminary hearing was held at Reading Central Court and the alleged victim and the other male witness testified for the Commonwealth. On cross examination Attorney Nevins got the male to admit that he was intoxicated and he had actually pushed the female into her vehicle with such force that the windshield was smashed. Attorney Nevins introduced a photograph of the female’s vehicle showing the smashed windshield. Further, on cross examination, the male admitted that following this altercation he and the other male left the female lying in the parking lot before fleeing the scene.

In the end the District Judge dismissed the misdemeanor charge and instead assessed a small fine for the scratches caused.
