ENM Law News: Successful PFA outcome

Attorney Ebner recently represented a Protection from Abuse defendant in a case filed by family members. Eviction is one of the forms of relief that a judge is able to order when granting a PFA and Attorney Ebner felt that the PFA was filed by the plaintiff as a means of getting her clients evicted. Attorney Ebner represented her clients at a PFA hearing and successfully argued that the PFA petition was not filed because the plaintiff was in fear of the defendant, but instead was filed as a means to have the defendants removed from the home to allow for another family member to move in. The case was dismissed with prejudice and these clients avoided evictions, court costs and potential Indirect Criminal Contempt charges.
